In connection with online trading at paustian.com, you automatically acknowledge having read and understood the below terms and conditions of sale and delivery. Changes are only valid if Paustian A/S has separately and in writing given its consent.

Conclusion of purchase agreement
When you order an item online at paustian.com, we will subsequently send you an order confirmation by e-mail. Information provided by customers when placing an order is used in relation to the collection of payment and the shipment of the item.

Acceptance of electronic communication
In connection with online purchases from Paustian A/S' webshop, customers accept that communication and messages can be sent to the e-mail address provided by customers. Customers hereby accept that electronic messages have the same legal effect as those not sent by electronic mail.

Prices
All prices on paustian.com are incl. VAT.

Terms of payment
Payment for items ordered must be made online with the credit cards described under "About credit cards". Payment for the order is not withdrawn from the specified account until we have dispatched the goods.

All customers paying with a credit card are subject to validation control, and Paustian A/S reserves the right to withhold an order if it is assessed that further security control is required.

Delivery
In connection with online purchases from Paustian A/S' webshop, we offer free delivery to the Danish address provided by buyer, including islands connected by bridge (excluding Greenland and the Faeroe Islands), for orders exceeding DKK 499. If the order contains large items, delivery to curb applies. Paustian A/S chooses the means of transport and route to the delivery address provided, and buyer immediately assumes liability for the product upon delivery. All other delivery is ex warehouse Copenhagen with a surcharge for delivery. Expected delivery time is up to 8 weeks from the order date as long as the item is not on backorder. If the order involves delivery of large items, customers will be contacted by telephone in order to arrange for delivery. For delivery outside the Paustian webshop, delivery time will be provided and agreed upon with the sales person involved.

Delivery outside Denmark
In case of delivery outside Denmark, buyer pays all shipping and freight costs.

When ordering goods for delivery outside the EU, buyer does not pay Danish VAT, but VAT, import fees and/or taxes may be charged in accordance with national rules as soon as the package arrives at the country of destination. Unfortunately, Paustian A/S cannot predict the amount that may be charged on the order. Buyer is solely responsible for paying all relevant import costs to the country of destination.

Paustian A/S no longer assumes liability for the goods from the point when they are delivered to the freight company.

Right of cancellation of online purchases
Customers may cancel orders for goods purchased on the Paustian webshop within two weeks, counting from the time customers receive the product. Should the first day after the two weeks be a public holiday, Constitution Day, Christmas Day or New Year's Eve, the deadline for returning the product is on the following business day.

If the order consists of several lots or parts, the cancellation deadline expires two weeks after the day customers receive the last lot, or the final part is in customers' physical possession.
Within two weeks of receipt of the order, Paustian A/S must be notified that buyer wishes to cancel the purchase by using the enclosed cancellation form. In this notice, customers must clearly inform Paustian A/S that they want to use the right of cancellation.
Buyer cannot cancel by simply refusing to receive the item without clearly notifying Paustian A/S.

Returned products
Customers must send the order back to Paustian A/S without undue delay and no later than two weeks after notifying us of the cancellation of the purchase. If a purchase is cancelled, the return label that was received with the item may be used. Please keep the package number until we have confirmed receipt of the return package. Customers pay the return charge – the amount is deducted from the credit note. Customers carry the risk of the goods until the time of delivery of the goods to Paustian A/S.

If the original packaging is missing, this may reduce the value, so it is recommended that the item be returned in original packaging. This will ensure that the full amount can be returned to customers.

Certain goods cannot, by their nature, be returned by ordinary mail. This applies to large items such as armchairs, sofas, etc.

If Paustian A/S is selling a product tailored individually to the customer's needs, please note that the right of cancellation is only valid until the manufacturing/customisation of the product has commenced.


Condition of the product when returned
Customers are liable for any degradation of the product's value due to other handling than what is required in order to determine the nature, characteristics and functioning of the product. In other words, customers can try the product in the same way as if it was tried in a physical store, but the product cannot be taken into actual use.

If the product has been tested beyond what is described above, Paustian A/S considers it as being used, which means that, upon cancellation of the purchase, customers will only receive part or none of the purchase amount, depending on the product's commercial value.

Repayment of purchase amount
If customers regret the purchase, we will refund the amount paid. In the case of a loss of value, for which customers are liable, this will be deducted from the purchase amount.

If customers make use of the right of cancellation, we will refund all payments received without undue delay and, in any event, within two weeks from the date of receipt of the notice of cancellation of the purchase. Paustian A/S will make the repayment with the same method of payment used for the original transaction unless customers have expressly accepted otherwise.

We can withhold the refund until we have received the return unless customers have submitted sufficient documentation of returning the item.

In case of cancellation of the purchase, the item must be returned to: Paustian A/S, Kattegatvej 38, DK-2150 Nordhavn.

We do not accept packages without distribution or packages sent COD.


Force majeure
All orders are accepted subject to force majeure, including war, civil unrest, natural disasters, strikes and lock-outs, shortage of raw materials, fire, damage to Paustian A/S' or Paustian A/S' supplier's production equipment or storage facilities, transportation issues, import/export prohibition, or any other event, which prevents or restricts Paustian A/S' ability to deliver. In case of force majeure, Paustian A/S can choose to cancel the order or to deliver the agreed items as soon as the hindrance to normal delivery has ceased to exist. In case of force majeure, Paustian A/S accepts no liability for any loss suffered by buyer as a result of non-delivery.

Right of complaint
The rules on defects contained in the Danish Sale of Goods Act apply.

When customers place an order with Paustian A/S in the capacity of a consumer, they have 24 months' right of complaint. This means that customers can either get the item repaired or replaced, or have the purchase price returned or reduced, depending on the specific situation. It is a requirement that the complaint is justified and that the defect has not arisen as a result of incorrect use of the product or other injurious behaviour.

Customers must lodge a complaint within "reasonable time" after discovering the defect in the item. If a complaint is lodged within two months after the defect is discovered, the complaint will always be deemed to be timely.

If the complaint is justified, Paustian A/S will refund customers' (reasonable) shipping costs. The item must always be returned in proper packaging. Remember to get a receipt for shipping so that Paustian A/S can refund shipping costs.

When an item is returned, customers must state the reason for the complaint in as much detail as possible.

Product liability
To the extent that mandatory legal provisions do not specify otherwise, Paustian A/S is not responsible for operating loss, loss of profit or any other indirect loss due to product defects. Reference is also made to the rules of the Danish Product Liability Act.

Avenues of complaint
A complaint relating to a product or service procured from Paustian A/S must be submitted to the Danish Competition and Consumer Authority's Consumer Complaints Board, Carl Jacobsens Vej 25, DK-2500 Valby. Complaints can be lodged with the Consumer Complaints Board via www.forbrug.dk.

The EU Commission's online complaint portal can also be used for lodging a complaint. This is particularly relevant if consumers are domiciled in another EU country. Reservations
Paustian A/S makes no guarantees against deviations in colour rendering on photographs of products, errors in prices or typographical errors, etc. on the webshop. Also subject to changes in VAT and tax.

Disputes
Disputes must be settled in accordance with Danish law with the venue being the City Court of Copenhagen unless otherwise stipulated in mandatory consumer legislation.

Protection of personal data

Webshop:
In order to conclude an agreement with Paustian A/S, we need the following information on customers: Name, address, telephone number, and e-mail address.

We register customers' personal data with the purpose of being able to deliver the goods.

Personal data is registered with Paustian A/S and is stored for five years, after which time it is deleted. Customers' data is not disclosed or sold to third parties.

When customers are registered with Paustian A/S, they are always entitled to object to the registration, and they have right of access to what data is registered. Customers have these rights under the Danish Data Protection Act, and any queries in this respect should be addressed to: paustian@paustian.dk.
